You must not use our products, services or website for any unlawful or unauthorised purpose. You must not transmit any worms, viruses or any code of a destructive nature.

A breach of these Terms may result in immediate termination of your access to our services.

3. General conditions

We reserve the right to refuse service to anyone, for any lawful reason, at any time.

We may modify or discontinue any part of the website or any product offering without notice at any time.

We do not guarantee that your use of our website will be uninterrupted, timely, secure or error-free

4. Products and product descriptions

We specialise in guitars, amplifiers and related musical equipment, including vintage, used, rare and collectible items. Many items sold by us are pre-owned, vintage or specialist products and may show signs of age, use, repair, modification or wear.

We aim to ensure that product descriptions, specifications, photographs and prices are accurate. However:

  • descriptions, measurements and weights are approximate unless expressly stated otherwise
  • colours and finishes may appear differently depending on your screen or device
  • vintage and used items may contain marks, repairs, changed parts or other characteristics consistent with age and use
  • statements regarding originality, condition, provenance or specification are given in good faith based on the information available to us at the time of listing

You are responsible for reviewing all product details carefully before purchase. If you require further information, images or clarification before ordering, you should contact us.

5. Availability and acceptance of orders

All products are offered subject to availability. Adding an item to your basket or completing checkout does not guarantee availability.

After placing an order, you will receive an acknowledgement email. This does not mean that your order has been accepted. A contract is formed only when we confirm acceptance of your order and, where applicable, dispatch the goods.

We reserve the right to refuse or cancel any order, including where:

  • the item is no longer available
  • there has been an error in the description or price
  • we suspect fraudulent, unlawful or unauthorised activity
  • we are unable to verify payment or customer details
  • shipping restrictions apply

If we cancel an order after payment has been taken, we will refund the amount paid using the original payment method.

6. Pricing and payment

All prices shown on the website are in [GBP / insert currency] unless otherwise stated.

Prices may be changed at any time without notice. We take reasonable care to ensure prices are correct, but errors may occasionally occur. If a pricing error is identified after your order is placed, we are not obliged to supply the item at the incorrect price. We will contact you with the correct price and give you the option to proceed or cancel.

Payment must be received in full before dispatch unless otherwise agreed in writing.

You agree to provide current, complete and accurate purchase and account information for all orders placed through our site.

7. International orders, taxes and duties

If we sell and ship internationally, you are responsible for ensuring that the item may be lawfully imported into the destination country.

International orders may be subject to import duties, taxes, customs fees, handling charges or other local charges. These are the responsibility of the customer unless expressly stated otherwise.

We are not responsible for delays caused by customs, import procedures or local delivery services.

8. Shipping and delivery

We will make reasonable efforts to dispatch goods within the estimated timeframe stated at checkout or otherwise communicated to you. Delivery times are estimates only and are not guaranteed.

Risk in the goods passes to you on delivery. Ownership of the goods passes only when we have received full cleared payment.

You must inspect the goods promptly upon delivery. Any damage in transit, missing items or delivery issues should be reported to us as soon as possible and, where relevant, within the timeframe required by the courier.

We are not liable for delays or failures caused by events outside our reasonable control, including courier delays, customs delays, strikes, weather, supply chain disruption or force majeure events.

9. Returns and cancellations

Your rights to cancel and return goods may depend on the nature of the product, your location, and whether you are purchasing as a consumer or a business.

If you are a consumer in the UK or EU and you purchase online, you may have a legal right to cancel certain orders within the applicable cooling-off period, subject to statutory exceptions.

However, your right to return may be reduced or excluded where permitted by law, including for goods that have been altered to your specification, damaged after delivery, or otherwise exempt under applicable consumer legislation.

Returned items must be sent back in the same condition in which they were received, with any case, certificates, accessories, tags and documentation included.

Refunds may be reduced to reflect any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics and function of the item.

Please also refer to our separate Refund Policy for full details.

10. Vintage, used and collectible instruments

Where we sell vintage, rare, collectible or used instruments, you acknowledge that such items are not factory-new and may not perform or present identically to modern production instruments.

Normal characteristics of vintage or used instruments may include lacquer checking, replacement parts, repairs, rewinds, refrets, changed hardware, wear to frets, finish fading, oxidisation, and age-related movement in wood or hardware.

Any statement as to originality, year, model, provenance or historical association is given to the best of our knowledge and belief but may rely in part on third-party information, serial numbers, manufacturer records or prior ownership history. Except where required by law, such details are not warranties or guarantees.

11. Part exchange, consignment and purchasing from customers

Where we offer part exchange, consignment, brokerage or outright purchase services, any such transaction may be subject to separate written terms. We reserve the right to inspect, test and authenticate items before agreeing any transaction.

Quoted values are provisional unless confirmed in writing following inspection.

12. Accuracy of billing and account information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order.

You agree to provide complete and accurate account information for all purchases made via our website, and to promptly update your information so we can complete your transactions and contact you where necessary.

Our total liability in respect of any claim arising from the supply of goods or use of the website shall not exceed the amount paid by you for the relevant product or service.

20. Indemnity

You agree to indemnify, defend and hold harmless Rare Guitars Limited, its directors, officers, employees, agents and affiliates from any claim or demand arising out of your breach of these Terms or your violation of any law or the rights of a third party.

21. Severability

If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision shall nevertheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.

22. Termination

These Terms remain effective unless and until terminated by either you or us.

We may terminate or suspend your access to the website or our services at any time if, in our reasonable opinion, you have failed to comply with any part of these Terms.

23. Entire agreement

These Terms of Service, together with any policies posted by us on this website, constitute the entire agreement between you and us in relation to your use of the website and any purchase made through it, unless otherwise agreed in writing.
